Distance Sales Agreement

Goodness Gıda Kozmetik Sanayi ve Dış Ticaret A.Ş

This agreement has been issued in relation to the execution of agreements for sales on internet as per the Regulation on Distance Agreements Implementation Rules and Principles numbered 25137 and dated 13.06.2003, and the agreement’s provisions are as follows.


The subject of this agreement involves the rights and obligation of the parties in relation to the sales and delivery of the product that was sold by the SELLER to the PURCHASER, and of which the quality and the sales price provided below, as per the provisions of Law Nr. 4077 on the Protection of Consumers - Regulation on Distance Agreements Implementation Rules and Principles.

The person who logged in as customer to the  www.goodness-company.com shopping website.
The address and the contact entered into the system during shopping are taken as basis.


The type, amount, make/model, color, quantity, sales price, payment method of the Good / Product / Service are comprised of the information provided when the order is finalized.


4.1- The PURCHASER declares that they have read the preliminary information in relation to the qualities, sales price, payment method and delivery of the product or products that were provided as the subject of this agreement in Article 3, and that they have provided the necessary confirmation electronically. 

4.2 – Provided that it does not exceed the 30 days of legal duration for delivery, and for each product, the product or products subject to this agreement shall be delivered to the PURCHASER or the person/organization the PURCHASER designated within the period provided in the preliminary information depending on the distance of the PURCHASER’S residence. This period can be extended for a maximum of 10 days, provided that such is notified to the PURCHASER prior to the extension.
4.3 – If the product subject to this agreement is to be delivered to a person/organization other than the PURCHASER, Goodness shall not be held liable for the nonacceptance of the product by such person/organization. 

4.4 – Goodness shall be liable for delivering the product subject to this agreement intact, complete, pursuant to the qualities specified in the agreement, and if any, with the warrant documentation and user manuals. 

4.5 – In order for the delivery of the product subject to this agreement, the signed copy of this agreement must have reached Goodness and the price for the product must have been paid as per the payment method chosen by the PURCHASER. If the product price is not paid or the payment is cancelled in bank records for whatsoever reason, Goodness shall be deemed to have been released from its obligation to deliver the product. 

4.6 – After the delivery of the product, if the relevant bank or the financial institution does not pay the price of the product to Goodness due to unlawful and unfair use of the credit card of the PURCHASER by unauthorized persons that is not due to the fault of the PURCHASER, the said product is required to be returned to Goodness within three days, provided that the said product is delivered to the PURCHASER. In this case, the shipment costs shall be borne by the PURCHASER.

4.7 – If Goodness fails to deliver the product subject to this agreement within the allocated time period due to force majeure or due to extraordinary conditions such as adverse weather conditions, halting of transportation, then Goodness is required to notify the PURCHASER of such situation. In this case, the PURCHASER may exercise their right to cancel the order, to replace the product subject to this agreement with a similar product, and/or to postpone the delivery of the said product until the adverse condition affecting delivery cease to exist. If the PURCHASER cancels the order, the amount the PURCHASER has paid for the product shall be fully paid in cash to the PURCHASER within 15 business days. 

4.8 – If there are any defective products among the products delivered, such product may be returned to Goodness, and in this case, Goodness shall bear the transportation costs.


The PURCHASER has the right of withdrawal for the product subject to this agreement within seven days after such product is delivered to the PURCHASER or the person/organization designated by the PURCHASER. In order to be able to exercise the right of withdrawal, the PURCHASER shall notify Goodness via email or telephone within this period, and the product must be used within the scope of the relevant articles of this agreement. If this right is exercised, the delivery receipt that indicates the product is delivered to the PURCHASER or a third party, and the original of the product invoice shall be returned to Goodness. The product price shall be returned to the PURCHASER within 15 days after such documents are received by Goodness. If the original invoice is not returned, then the VAT and other similar legal liabilities (if any) shall not be returned. If a product is returned by exercising the right of withdrawal, then the shipment cost of the returned product shall be borne by the PURCHASER.
The right of withdrawal cannot be exercised for the products that are expired.
In case the payment is made through a credit card or a payment card of similar nature, the consumer may request the cancellation of the payment transaction due to card being used unlawfully and without consent. In this case, the issuer of the card shall return the payment amount within 15 days after such issuer is notified of the rejection of payment.
For the performance of this agreement, Consumer Arbitration Committees and Consumer Courts located at the place of residence of Goodness shall be authorized up to the amount declared by the Ministry of Industry and Commerce.
If the order is finalized, the PURCHASER shall be deemed to have accepted all terms of this agreement.
